The terms and conditions set out below are the terms on which Old Friends offers you access to the Old Friends services. By registering as a member of Old Friends, you accept the terms and conditions set out herein.

Note: Old Friends is a website wholly owned and operated by Trade Me Ltd. Trade Me Ltd also operates Trade Me, an online auction site.

Acceptance of terms
These terms and conditions may be updated from time to time, without notification. You are responsible for ensuring you are familiar with the latest terms and conditions.

Description of the Old Friends service
Old Friends provides a service to put people in touch with one another. The Old Friends system allows registered members to contact other registered members through a private email system. As a member, you consent to receiving emails from other members who contact you through Old Friends. Old Friends does not review the messages sent through the system and does not take responsibility for the content of the messages sent.

All services provided by Old Friends are provided "as is". Old Friends assumes no responsibility for the timeliness of communications, the mis-delivery of information, the availability of the service, or the misconduct of its members.

Old Friends provides a contact page, through which users of the Old Friends service can notify us of the misconduct of any participants on the Old Friends site.

As a member of Old Friends you will receive emails relating to your membership and other activities on the Website and for promoting and marketing other Trade Me products and services to you. You may also receive regular electronic newsletters that are sent to Old Friends members. Newsletters will contain clear and obvious instructions for how you can unsubscribe from the mailing list.

Your obligations as a member
Becoming a member is free. There are no restrictions on who may become a member of Old Friends. As a member of Old Friends, you agree to the terms and conditions set out in this document. Your obligations as a user and member of Old Friends are:

1) You will provide complete and accurate personal information when registering to use the service. You will maintain your personal information to keep it true, accurate and complete at all times.

2) You will not register under multiple identities or personas.

3) All communications through Old Friends shall be made in good faith.

4) You will NOT contact members or use Old Friends for the purpose of commercial solicitation (SPAM). Old Friends reserves the right to prosecute persons or companies attempting to contact Old Friends members for commercial gain.

5) You will only add institutions (schools, companies, etc) that are known to exist and can be verified.

6) You will NOT use Old Friends to promote a business or website.

7) You shall not attempt to damage or harm the Old Friends site or services.

8) You shall not list your email address anywhere on Old Friends, other than where email address is requested.  


Removal of members
Old Friends reserves the right to remove memberships at their discretion without entering into further discussions with the member concerned. The management of Old Friends (a site operated by Trade Me Ltd), also reserve the right to remove members from any of the other sites in the Trade Me group of sites (www.trademe.co.nz, www.safetrader.co.nz, www.findsomeone.co.nz, etc) for any breach or perceived breach of these terms and conditions.

System Integrity
Old Friends will make the best possible efforts to ensure the highest possible availability of the Old Friends site and services.

Old Friends takes no responsibility for any lack of system availability, or any losses that are incurred as a result of site availability or performance. No responsibility is assumed by Old Friends for the corruption of any of the data held by Old Friends.


Arbitration of disputes
Old Friends will not take part in the resolution of disputes that arise as a result of the services provided. Disputes should be resolved between the parties in dispute either directly, or through the use of an appointed arbitrator.

LIMITATION OF LIABILITY
You expressly understand and agree that:

Old Friends shall not be liable for any direct, indirect, incidental, special, consequential or exemplary damages, including but not limited to, damages for loss of profit, goodwill, use, data, or other intangible losses that result from the service, or the inability to access the service.
